The overseas travel ban imposed on State Minister of Tourism Diana Gamage has been extended till December 15 by Colombo Chief Magistrate Nandana Amarasinghe yesterday.
When the case was taken up before the Magistrate, President’s Counsel Sarath Jayamanne appearing   on behalf of the State Minister Diana Gamage informed the Magistrate that none of the officers including the Controller-General of Immigration and Emigration had made a complaint against his client.
He further stated that an outside party that is not directly involved in the proceedings of the case had obtained the overseas travel ban on his client.

PC Jayamanne requested the Magistrate to lift the travel ban imposed on his client. He also stated that the Criminal Investigations Department had sought advice from the Attorney General and AG has not yet decided that Diana Gamage has committed any offense.

He further stated that his client has not been yet named as a suspect in this case. PC Jayamanna further highlighted that his client Diana Gamage is a Sri Lankan citizen and she had revoked her British Citizenship prior to the Parliamentary Election.

President’s Counsel Rienzie Arsekularatne appearing for Oshadha Herath, the complainant raised strong objections and requested the court to reject the request made by the defense.

PC Arsekularatne requested the Magistrate to issue an order directing the Criminal Investigations Department to arrest Diana Gamage. He further highlighted that Diana Gamage has committed offenses under sections of the Immigrants and Emigrants Act (1948 No.18).

He also questioned why the law that applies to other people in the country is not applied against Diana Gamage? After taking the facts into consideration, the Magistrate observed that all these problems have arisen because it appears to the court as well as to the rest of the people that the investigations have not been carried out properly.

The Magistrate fixed further inquiries into the matter on December 15 and ordered the Criminal Investigation Department to submit an investigation report related to the incident on that day.
